What a change of name or address involves

A Chinese trademark registration records who owns it and at what address. When the owner is renamed, moves, or has its address restated, the law requires a change application so the register matches reality. The change updates the entry only: the registration number, the mark, the classes and the rights it gives you are all untouched.

The reason to bother is practical, not bureaucratic. Every official document in the life of a registration is served at the recorded address — the refusal notice, the opposition papers, the renewal reminders, the cancellation application filed by somebody else. An owner whose registered address is a former office may only learn that a deadline passed when it has already passed.

It also matters for anything you do with the mark later. Assignments, licence recordals and renewal filings all have to line up with the register, and a mismatch between the recorded owner and the company’s current papers stops the transaction. We check the register against your current company documents before filing, which is where most of these cases go wrong.

Where a change of name is involved, the CNIPA expects supporting evidence from the company register — a certificate showing the old name and the new one are the same entity. That is a document most foreign clients can produce from their own registry, and it does not have to be notarized or legalized for this purpose.

What you need to change the register

A change application is short: the registration, what is being changed, and proof where the change comes from a company name. Nothing has to be notarized — clean scans are enough.

The registration number Or the mark itself if you do not have the number. Where several registrations are affected, a list is enough to start and we confirm each one.
What is being changed The new registered name or address, exactly as it appears in your current incorporation documents. Small differences in punctuation or company suffix cause objections, so we check the wording.
Evidence of a name change For a change of company name, a certificate or extract from the company register showing the old name and the new one. Most foreign registries issue this on request, and it does not need notarization or legalization.
Signed Power of Attorney A foreign registrant without a business presence in China must act through a CNIPA-registered agent. We send our standard form — a plain signed scan is enough, no notarization.

Change of Name or Address on a Chinese Trademark — common questions

Do I really need to update a registered address in China?
Yes, if the address on the register is no longer where your company is. Official documents in the life of a registration are served at the recorded address, so an out-of-date entry means a refusal notice, an opposition or a renewal reminder can pass you by. The law requires the change to be applied for when the registered details change.
Does changing the name affect my trademark rights?
No. The change updates the owner details on the register only. The registration number, the mark, the classes and the rights it gives you are unchanged — which is precisely why a rename is handled as a change rather than as an assignment.
What is the difference between a change and an assignment?
A change keeps the same legal owner and updates its details. An assignment moves the mark to a different legal entity. If a company is renamed, that is a change. If the mark is sold to, or moved into, another company, that is an assignment and a different filing.
Does the supporting certificate have to be notarized?
No. For a change of name the CNIPA works on a clean copy of the certificate or extract from your company register. Notarization and legalization are not part of this procedure and we do not ask clients to obtain them.
Can I change several registrations at once?
Yes, and it is usually sensible to do so: each registration is filed separately, but a single instruction covering the same change across a portfolio keeps the register consistent and the paperwork in one place.
What happens if the register does not match my company documents?
Transactions involving the mark — an assignment, a licence recordal, a renewal — all have to line up with the register. A mismatch between the recorded owner and the current papers stops the filing until it is corrected, which is why we check the two against each other before submitting anything.
